Terms of Service (Last updated September 2024)
Please read these Terms of Service ("Terms") carefully before using the services provided by service provider (Carly Lewisohn sometimes known as Kurlender and Digital Wellbeing Centre). ("we," "us," or "our"). By accessing or using our services, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our services.
1. Scope of Services
The Service Provider agrees to provide the following services to the client depending on requirements: digital wellbeing consultation, 1-1 coaching, in person workshops, talks, on line webinars, online safety workshops. Services are not medical treatment and are for wellbeing purposes only.
Terms of Service for Free Online Webinars:

Registration and Confirmation
To attend the webinar, participants must complete the registration form. Upon registration, participants will receive a confirmation email with a link to join the webinar. The Service Provider is not responsible for any access issues due to incorrect registration details. -
Use of Participant Data
By registering for the webinar, participants consent to the use of their personal data for providing webinar access and related communications. Participants may opt out of further communications at any time. -
Webinar Content Disclaimer
The content provided during the webinar is for informational purposes only and does not constitute professional advice. The Service Provider shall not be held responsible for actions taken based on the information provided. For additional details on liability, refer to Section 4 of these Terms under Liability Limitation, which outlines further details. -
Intellectual Property
All webinar materials, including recordings, are the intellectual property of the Digital Wellbeing Centre. Participants may not share or distribute these materials without prior written consent and credit must be made to Digital Wellbeing Centre. -
Recording and Privacy
The webinar may be recorded for future use. By participating, participants consent to the recording. Participants wishing to remain anonymous should disable their video and mute their microphone. -
Cancellation or Rescheduling
The Service Provider reserves the right to cancel or reschedule the webinar. Participants will be notified via email of any changes and provided with alternative arrangements where possible. -
Limitation of Liability
The Service Provider is not responsible for any technical difficulties that prevent access to the webinar. No compensation will be provided for free webinars in the event of technical issues.
Terms of Service for Coaching:
Coaching is partnership (defined as an alliance, not a legal business partnership) between the Coach and the Client in a thought-provoking and creative process that inspires the client to maximize personal and professional potential. It is designed to facilitate the creation/development of personal, professional or business goals and to develop and carry out a strategy/plan for achieving those goals.
a) Coach-Client Relationship A. Coach agrees to maintain the ethics and standards of behavior established by the International Coach Federation “(ICF)” (Coachfederation.org/ethics). It is recommended that the Client review the ICF Code of Ethics and the applicable standards of behavior. B. Client is solely responsible for creating and implementing his/her own physical, mental and emotional well-being, decisions, choices, actions and results arising out of or resulting from the coaching relationship and his/her coaching calls and interactions with the Coach. As such, the Client agrees that the Coach is not and will not be liable or responsible for any actions or inaction, or for any direct or indirect result of any services provided by the Coach. Client understands coaching is not therapy and does not substitute for therapy if needed, and does not prevent, cure, or treat any mental disorder or medical disease. C. Client further acknowledges that he/she may terminate or discontinue the coaching relationship at any time. D. Client acknowledges that coaching is a comprehensive process that may involve different areas of his or her life, including work, finances, health, relationships, education and recreation. The Client agrees that deciding how to handle these issues, incorporate coaching principles into those areas and implementing choices is exclusively the Client’s responsibility. E. Client acknowledges that coaching does not involve the diagnosis or treatment of mental disorders and that coaching is not to be used as a substitute for counselling, psychotherapy, psychoanalysis, mental health care, substance abuse treatment, or other professional advice by legal, medical or other qualified professionals and that it is the Client’s exclusive responsibility to seek such independent professional guidance as needed. If Client is currently under the care of a mental health professional, it is recommended that the Client promptly inform the mental health care provider of the nature and extent of the coaching relationship agreed upon by the Client and the Coach. F. The Client understands that in order to enhance the coaching relationship, the Client agrees to communicate honestly, be open to feedback and assistance and to create the time and energy to participate fully in the program
b) Procedure The time of the coaching meetings and/or location will be determined by Coach and Client based on a mutually agreed upon time.
c) Confidentiality This coaching relationship, as well as all information (documented or verbal) that the Client shares with the Coach as part of this relationship, is bound by the principles of confidentiality set forth in the ICF Code of Ethics. However, please be aware that the Coach-Client relationship is not considered a legally confidential relationship (like the medical and legal professions) and thus communications are not subject to the protection of any legally recognized privilege. The Coach agrees not to disclose any information pertaining to the Client without the Client’s written consent. The Coach will not disclose the Client’s name as a reference without the Client’s consent. Confidential Information does not include information that: (a) was in the Coach’s possession prior to its being furnished by the Client; (b) is generally known to the public or in the Client’s industry; (c) is obtained by the Coach from a third party, without breach of any obligation to the Client; (d) is independently developed by the Coach without use of or reference to the Client’s confidential information; or (e) the Coach is required by statute, lawfully issued subpoena, or by court order to disclose; (f) is disclosed to the Coach and as a result of such disclosure the Coach reasonably believes there to be an imminent or likely risk of danger or harm to the Client or others; and (g) involves illegal activity. The Client also acknowledges his or her continuing obligation to raise any confidentiality questions or concerns with the Coach in a timely manner.
2. Fees and Payment Terms
The Client agrees to pay the Service Provider- Digital Wellbeing Centre|Carly Lewisohn for the services outlined in this agreement. Payment is due within 30 days after each session. If payment is not made on time, the statutory interest rate of 8% plus the Bank of England base rate will be applied. Late payments may also incur a fixed late payment compensation as per UK Law.

3. Confidentiality
The Service Provider agrees to keep all information shared by the Client during the course of services strictly confidential, unless required by law. The Service Provider will not disclose any personal or sensitive information without the Client's written consent.
The Service Provider may request permission to use the Client's logo, name, and testimonials for promotional purposes on their website, social media channels, or marketing materials. This will only be done with the prior consent of the Client. The Client reserves the right to decline with good reason.
4. Liability Limitation
The Service Provider shall not be held liable for any physical, emotional, mental, or financial harm arising from the Client’s participation in services. The Client acknowledges that wellbeing consultations are not a substitute for medical advice or treatment and agrees to consult with a healthcare provider when necessary. The Client acknowledges that results are not guaranteed and are dependent on their own actions and decisions.
The Service Provider’s liability is limited to the total amount paid for services under this agreement. Services are not medical treatment and are for wellbeing purposes only.
5. Force Majeure
Neither party shall be liable for delays or failure to perform any obligation under this agreement due to events beyond their reasonable control, including but not limited to acts of God, war, pandemic, transport or government action. In such cases, both parties agree to reschedule services at the earliest mutually convenient time.
6.Termination Clause
Either party may terminate this agreement with 14 days written notice. Upon termination, the Client agrees to pay any outstanding fees for services rendered up until the termination date. Any prepaid sessions will be refunded if cancelled before the service is provided, minus any applicable cancellation fees.
7. Refunds
Refunds will only be issued for cancellations made within the terms of the cancellation policy. No refunds will be provided for missed sessions or cancellations made outside the agreed-upon notice period of 14 days, unless otherwise agreed in writing by both parties.
Refunds will not be provided for services that have already taken place, except in exceptional circumstances at our discretion.
8. Governing Law:
- These Terms are governed by and construed in accordance with the laws of the United Kingdom.
9. Changes to Terms:
- We reserve the right to update or modify these Terms at any time. Changes will be effective upon posting on our website. It is your responsibility to review these Terms periodically for updates.
By requesting and using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
